1. Acceptance of Terms

By placing an order through our website or mobile application, you agree to these Terms and to any documents they expressly incorporate (for example, our Privacy Policy). If you do not agree, do not use our online ordering services.

2. Orders

All orders are subject to acceptance by Maison Blandine Wartel. We may refuse or cancel any order for any reason, including but not limited to: unavailability of items, pricing errors, incorrect address, suspected fraud, or if we cannot meet requested delivery/pickup times.

• Confirmation: You will receive an order confirmation email or SMS when your order is received. This is not a guarantee of acceptance.
• Acceptance: An order is accepted when we send a second confirmation (e.g. "Your order is ready" or "Your order is out for delivery") or when we begin preparing the order.
• Custom Orders: For custom cakes or special requests we may require written confirmation and payment in advance.

3. Pricing & Payment

Prices shown on the website are subject to change. We make reasonable efforts to display accurate prices, but errors can occur.

• Payment: We accept the payment methods displayed at checkout. Payment is charged at the time you place the order unless otherwise specified.
• Taxes & Fees: Applicable taxes, delivery fees, service charges, and tips may be added at checkout.
• Pricing Errors: If an item is listed at an incorrect price due to error, we reserve the right to refuse or cancel the order and notify you.

4. Cancellations & Refunds

Because our products are perishable and often made to order, cancellation and refund rules depend on timing and order type.

• Cancellation window: Orders may be canceled up to 24 hours before the scheduled pickup or delivery time for a full refund unless otherwise stated for special/custom items.
• Late cancellations & no-shows: Orders canceled within 24 hours, or orders not collected, are fully non-refundable to cover costs.
• Damaged or incorrect orders: If your order is incorrect or arrives damaged, contact us within 24 hours with photos and order details and we will evaluate for refund, credit, or replacement.

5. Delivery & Pickup

Delivery and pickup options depend on your location and what you select at checkout.

• Delivery windows: We provide estimated delivery windows and will make reasonable efforts to meet them but are not liable for delays caused by third parties, traffic, weather, or other factors.
• Recipient responsibility: If nobody is available to accept a delivery and safe delivery instructions are not provided, we may return the order to the bakery; you may be charged for that order.
• Pickup: Please bring your confirmation email/ID when picking up an order. Orders not picked up within 24 hours of scheduled pickup may be discarded and non-refundable.

6. Allergens & Dietary Information

We strive to provide accurate ingredient and allergen information for our products; however cross-contamination can occur in a bakery environment.

• Allergy notice: If you have a food allergy or intolerance, you must notify us at the time of order. We cannot guarantee the absence of allergens due to shared equipment and facility handling.
• Dietary requests: Special dietary requests (gluten-free, vegan, etc.) will be accommodated when possible — confirm at order placement. Some items are produced in shared facilities.

7. User Accounts

If you create an account, you are responsible for maintaining the confidentiality of your account and password, and for all activity under your account. Notify us immediately of any unauthorized use.

8. Intellectual Property

All content on our site (text, images, logos, design) is owned or licensed by Maison Blandine Wartel. You may not copy or use our content without permission.

9. Limitation of Liability

To the fullest extent permitted by law, Maison Blandine Wartel and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for direct damages is limited to the price you paid for the specific order at issue.

10. Indemnification

You agree to indemnify and hold harmless Maison Blandine Wartel from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of our services.

11. Termination

We may suspend or terminate access to our services at any time for any reason, including violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. When we do, we will post the updated Terms with a new "Last updated" date. Continued use of our services after updates constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of California, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of Contra Costa County, unless otherwise required by law.
